Description
INJURY AWARDS. INITIATIVE CONSTITUTIONAL AMENDMENT. This measure would prohibit laws limiting or restricting: (1) recovery by anyone injured by a licensed or certified Person acting "tvithin the course and scope of the person's occupation. (2) recovery by anyone injured by a person under influence of alcoHol or drugs from such person, or where alcohol and drugs were the proximate cause of the injury, from the person selling such to the person under the influence. (3) ability of injured person to retain an attorney of choice for such compensation as person agrees, or to collect any judgment in a lump sum. Summary of estimate by Legislative Analyst and director of Finance of fiscal impact on state and local governments: The adoption of this measure will result in increased costs to state and local governments. The amount of the increase cannot be determined, but probably is substantial.
