Abstract
The current California HIV transmission statute is ineffective because the intentional exposure mens rea requirement drastically limits prosecutors' ability to show culpability for those who expose others to HIV through sexual activity. This note proposes an amended statue, which allow for prosecuting those who knowingly expose others to HIV without disclosing to them their HIV -positive status.
