Abstract
An essential element of a conspiracy is a plurality of actors. When all alleged conspirators are agents of a single corporation, determining whether a plurality of actors is present poses several problems. This Article examines the plurality requirement of criminal conspiracy in the corporate setting. The Article concludes by proposing an analysis for the definition of corporate criminal conspiracy based on the substantive goals of criminal conspiracy law.
